Clarification Text on Protection and Processing of Personal Data
This clarification text is in accordance with Article 10 of the Law No. 6698 on the Protection of Personal Data. TRCOMPASS EMLAK İNŞAAT TURİZM SANAYİ VE TİCARET LİMİTED ŞİRKETİ ("Company") as the data controller within the scope of the Communiqué on the Procedures and Principles to be followed in the Fulfillment of the Disclosure Obligation.
a) Method of Personal Data Collection
Our Company collects your personal data directly from you (the data subject), the proxy acting on your behalf and/or persons authorized to act on your behalf by the following automatic or non-automatic methods, provided that they are part of our data recording system:
Data you have given directly to TrCompass Emlak: It refers to the personal data that users give to our Company on their own initiative before or during the use of our website with the domain name "trcompass.com" or by calling our call center. This personal data includes all personal data provided directly as a result of positive actions of Users. For example, name-surname, contact information, identity information, voice recordings, answers to surveys and content information are included in this type of data.
Data We Obtain When You Use Our Platform: It includes personal data regarding the usage habits of users obtained through certain software or technological tools during the service provided by our company. For example, this includes location data and favorites, as well as interests and usage data. Our Company collects usage data such as the number of pages viewed, the duration of the visit and the number of target completions by associating the behavior of the user who comes to the site with a cookie (cookie) in the browser, even if they are not a member, in order to enable online behavioral advertising and marketing. b) Personal Data Collected
Identity and Contact Information: Name, surname, cell phone, home phone, work phone, address.
Authentication Information: Users' membership information, passwords used to authenticate and access the account, Username, contact information, advertisement numbers.
Usage Data and Favorites: Reasons for the Data Subject to call our website or call centers, voice recordings, home value and region report information, date and time data when the product is used, province, district, neighborhood, products that the Data Subject looks at through the Portal, square meter prices, data belonging to the Data Subject specified in the relevant survey or banner so that the Data Subject can be directed to the relevant product through modules such as survey, banner redirection of domestic or foreign companies and product supplier companies can contact the Data Subject, Data entered by the Data Subject to obtain information about the projects of contractor companies for real estate projects through our website, information about banks for real estate sales of banks, prioritization options, preferred return method and date, channels responded to, last date of entry to our website, type of showcase advertisement used, type of shipment, websites visited, number of pages viewed, duration of visit and target completion number, search terms entered, categories of products and advertisements visited, errors and problems that occur during the use of the service.
Location Data: Location information of the location of the Relevant Person obtained when the Relevant Person wants to search for advertisements around his/her location during the use of the mobile application and if he/she gives permission.
Payment Data: Invoice and payment information of the Data Subject (name, surname, billing address, Turkish ID number, tax ID number), invoices sent to the Data Subject and receipt samples of the payments made by the Data Subject, payment number, invoice number, invoice amount, invoice cut-off date.
Survey and Test Answers: Responses given to periodic surveys and/or tests organized by our Company on our website and responses given to surveys and/or tests conducted by real and legal persons with whom our Company cooperates.

Survey and Test Answers: Direct marketing to these users, statistical analysis, improvement of processes and creation of databases by real and/or legal persons with whom we cooperate for the use of the functions of our website and the fulfillment of these functions by our Company and third real and legal persons with whom we cooperate within the scope of all processing activities mentioned above in accordance with the purposes of use of our website;
Providing goods / services, fulfilling obligations arising from contracts, establishing rights, protecting rights, conducting commercial and legal evaluation processes, conducting legal and commercial risk analysis, conducting legal compliance process, conducting financial affairs, fulfilling legal requirements, fulfilling the decisions of authorized institutions, organizations and authorities, responding to their requests, ensuring the physical security of the Company, using it as evidence in disputes that may arise
ç) To whom and for what purpose the processed personal data can be transferred
TrCompass Emlak may use the personal data of the User, in particular, to fulfill the requirements of the Membership Agreement and the Services, to improve the User experience (including improvement and personalization), to ensure the security of Users, to detect and prevent fraud, to improve the Services, to carry out inquiry activities that may be important for the Services, outsourcing service providers, business partners, suppliers, appraisal and real estate consultancy firms in order to achieve any of the purposes specified in the processing purposes section above, including conducting operational evaluation research, resolving errors, verifying User identities, improving system performance; corporate members, cargo companies, law offices, research companies, call centers, software companies for complaint management and security, agencies, consulting companies, companies in the printing sector, banks for real estate sales of banks, contracting companies for real estate projects, social media channels, third real and/or legal persons including certification bodies and authorized institutions, organizations, authorities, administrative and judicial bodies within the scope of legal obligations.
In addition, the User's Name and Contact Information will be shared with payment institutions for the purpose of identity verification in accordance with the payment institution framework agreement that the User will approve at the payment stage and in accordance with the Regulation on Measures to Prevent Laundering of Proceeds of Crime and Financing of Terrorism published in the Official Gazette dated January 9, 2008 and numbered 26751.
Your personal data obtained through cookies placed on your device may be shared with third parties for the scope and purposes specified in this Information.
TrCompass Emlak will be able to transfer personal data to third parties within the above-mentioned categories and purposes, limited and proportionate to these purposes, as well as abroad.
d) Legal Grounds for Processing Personal Data
Your personal data is subject to the provisions of Law No. 6698 5. and Article 6 of the Convention;
- It is clearly stipulated in the law,
- It is mandatory to fulfill its legal obligation
- It is directly related to the establishment or performance of the contract and processing is necessary (Membership Agreement, Terms of Use and performance of the contract based on them, establishment and protection of the right),
- Processing is mandatory for its legitimate interest (collecting the data necessary for TrCompass Emlak to carry out services, especially to prevent fraud, in its activities related to the Portal),
- The fact that it has been made public by you,
- Processing is necessary for the establishment, exercise or protection of a right,
- Explicit consent
It is processed automatically based on the legal reason or by non-automatic means provided that it is part of our data recording system.
f) The Personal Data Owner is required to comply with Article 11 of Law No. 6698. Rights enumerated in the article
As personal data owners, if you submit your requests regarding your rights to TrCompass Emlak through the methods set out below, TrCompass Emlak will finalize the request as soon as possible and within thirty days at the latest, depending on the nature of the request. In this context, personal data owners;
- Learn whether their personal data is being processed,
- Request information if their personal data has been processed,
- To learn the purpose of processing personal data and whether they are used for their intended purpose,
- To know the third parties to whom personal data are transferred domestically or abroad,
- To request correction of personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,
- Although it has been processed in accordance with the provisions of Law No. 6698 and other relevant laws, to request the deletion or destruction of personal data in the event that the reasons requiring its processing disappear and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,
- To object to the emergence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems,
- In case of damage due to unlawful processing of personal data, it has the right to demand compensation for the damage.
